1. Introduction
Welcome to Ewance. These Terms of Service ("Terms") govern your access to and use of the Ewance platform, including the website at ewance.com, the application at app.ewance.com, and any related content, features, and services we provide (collectively, the "Service").
The Service is operated by Aurea CV OÜ, a private limited company registered in Estonia (registration code: 16944269; VAT: EE102718876; registered office at Saani 2/2-26, 10149 Tallinn, Estonia) ("Aurea CV", "we", "us", "our"). Aurea CV also operates the LearnCoin credential infrastructure used to issue your verifiable credentials. References in these Terms to "Ewance" refer to the platform; references to "LearnCoin" refer to the credential infrastructure operated by the same company.
By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, you must not access or use the Service.
These Terms include important provisions about your rights, your responsibilities, intellectual property, dispute resolution, and the limits of our liability. Please read them carefully.
2. Eligibility
You may use the Service only if all of the following are true:
- You are at least 16 years of age.
- Your use of the Service does not violate any applicable law or regulation, including the General Data Protection Regulation (GDPR) and the Children's Online Privacy Protection Act (COPPA) where applicable.
- If you are using the Service on behalf of an organisation (for example, as a Recruiter representing your employer), you have the authority to bind that organisation to these Terms.
We do not knowingly collect data from or provide services to anyone under 16. If we discover that we have collected data from a person under 16, we will delete it. See our Privacy Policy for details.
3. Account types
The Service supports two types of user accounts:
- Student — a learner using Ewance to participate in challenges, build a portfolio, earn verifiable credentials, and (optionally) make their profile discoverable to Recruiters.
- Recruiter — a representative of a company, organisation, or talent function using Ewance to search for and connect with Students who have completed relevant challenges.
Different sections of these Terms apply depending on your account type. Sections 1 through 11 apply to all users. Section 12 contains additional terms that apply only to Students. Section 13 contains additional terms that apply only to Recruiters.
4. Your account
4.1 Creating an account
To use most features of the Service, you must create an account. When you do, you agree to provide accurate, current, and complete information, and to keep that information up to date.
4.2 Account security
You are responsible for keeping your login credentials confidential and for all activity that occurs under your account. You agree to notify us immediately at [email protected] if you suspect any unauthorised access to your account.
4.3 One account per person
You may not create more than one Student account for yourself. You may not create an account on behalf of another individual without their consent. You may not use another person's account.
4.4 We may suspend or close accounts
We reserve the right to suspend or terminate any account if we have a reasonable basis to believe the account has been used in violation of these Terms, our Acceptable Use Policy, or applicable law. Where reasonably possible, we will notify you before doing so and give you an opportunity to address the issue.
4.5 Closing your own account
You may close your account at any time through the account settings page or by contacting us at [email protected]. The effect of closing your account is described in Section 11 (Termination).
5. Your content
5.1 What is "Your Content"
"Your Content" means anything you submit, upload, post, or otherwise make available through the Service — including challenge submissions, portfolio items, profile information, team communications, feedback, and any other materials.
5.2 You own Your Content
You retain all ownership and intellectual property rights in Your Content. We do not claim ownership of anything you create on the Service.
5.3 Licence you grant us
To operate the Service, we need a limited licence to use Your Content. By submitting Your Content, you grant Aurea CV a worldwide, royalty-free, non-exclusive licence to host, store, reproduce, display, and adapt Your Content solely for the purposes of:
- Operating, maintaining, and providing the Service to you;
- Displaying Your Content on your profile and portfolio in accordance with your visibility settings;
- Making Your Content visible to Recruiters in accordance with your visibility settings (see Section 12.4);
- Producing anonymised and aggregated statistics about platform usage (for example, total submissions in a discipline, average completion times);
- Issuing verifiable credentials on the LearnCoin infrastructure for challenges you have completed.
This licence is purpose-limited. We do not grant ourselves the right to commercially sublicense Your Content to third parties, sell Your Content, or use Your Content in ways unrelated to operating the Service.
5.4 Licence ends when you remove content
The licence described in Section 5.3 ends when you delete the specific content from the Service, or when you close your account, except:
- For copies of Your Content that other users have legitimately downloaded or saved before deletion (which we cannot recall);
- For backup copies retained in accordance with our retention schedule (see our Privacy Policy);
- For anonymised, aggregated statistics derived from Your Content, which no longer identify you;
- For verifiable credentials already issued on the LearnCoin infrastructure (see Section 9).
5.5 Your responsibility for Your Content
You are solely responsible for Your Content and the consequences of submitting it. You represent and warrant that:
- You own Your Content, or you have all necessary rights to grant the licence in Section 5.3;
- Your Content does not infringe the intellectual property, privacy, publicity, or other rights of any third party;
- Your Content does not violate any applicable law or our Acceptable Use Policy;
- Your Content does not contain confidential information belonging to anyone else (for example, information from a previous employer that you are not authorised to disclose).
5.6 Sponsored challenges
If you participate in a challenge sponsored by a partner organisation, that challenge may have additional terms covering intellectual property, confidentiality, or other matters. Those additional terms will be presented to you at the time you accept the challenge. To the extent those terms conflict with these Terms, the additional sponsored challenge terms govern your participation in that specific challenge.
5.7 Team submissions
Some challenges allow or require team participation. For team submissions:
- Each team member retains ownership of their individual contributions;
- The team collectively retains ownership of the joint work, with each member holding an undivided interest;
- The licence in Section 5.3 applies to each member's contribution;
- Verifiable credentials are issued to each participating team member, with the team context recorded in the credential metadata.
6. Our platform and content
6.1 What we own
We own (or licence from third parties) all rights in the Service itself, including the software, design, interface, branding, written materials, and challenge content that we create or licence (collectively, "Platform Content"). We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform Content solely for your personal, non-commercial use of the Service (or, for Recruiters, internal business use as set out in Section 13).
6.2 AI-generated content disclosure
Some challenge content on the Service is generated using artificial intelligence systems, then reviewed and quality-gated by Aurea CV before publication. We disclose this transparently because we believe you should know how the materials you work with are produced.
6.3 What you may not do
You may not:
- Copy, modify, distribute, sell, or commercially exploit the Platform Content except as expressly permitted;
- Reverse engineer, decompile, or attempt to extract the source code of any part of the Service, except to the extent applicable law expressly permits this;
- Use automated tools (bots, scrapers, crawlers) to access the Service, except for public search engines crawling publicly accessible pages;
- Access the Service in order to build a competing product or service;
- Remove or alter any copyright, trademark, or other proprietary notices;
- Use the Service in any way that violates our Acceptable Use Policy.
7. Verifiable credentials and LearnCoin
When you complete a qualifying challenge, we may issue you a verifiable credential through the LearnCoin infrastructure operated by Aurea CV. These credentials are:
- Cryptographically anchored on the Base blockchain (a public, permissionless network);
- Linked to your identity via a decentralised identifier (DID) we generate for you;
- Standards-compliant (W3C Verifiable Credentials 2.0, Blockcerts v3, Open Badges 3.0);
- Independently verifiable by any third party using standard verification tools.
Your credentials outlive your account. Even if you close your Ewance account, the cryptographic record of your earned credentials remains valid and verifiable on-chain. You can continue to share verification links with employers, universities, or anyone else after closing your account.
What goes on-chain. Only a cryptographic hash and minimal verification metadata are stored on the blockchain. Your personal information (name, email, contact details) is stored off-chain in our systems and is subject to deletion in accordance with our Privacy Policy. If you exercise your right to deletion under GDPR, your off-chain personal data is deleted, which effectively unlinks the on-chain credential from you as an identifiable individual.
Revocation. In limited circumstances — for example, if a credential was issued in error or if a serious breach of the Terms is later discovered — we may revoke a credential. Revocation is handled through a standard BitstringStatusList mechanism and does not delete the original on-chain record; it simply marks the credential as revoked in a verifier's eyes.
8. Privacy
Your use of the Service is also governed by our Privacy Policy, which explains what personal data we collect, how we use it, and your rights under data protection law. By using the Service, you acknowledge that you have read and understood the Privacy Policy.
9. Cookies
Our use of cookies and similar tracking technologies is governed by our Cookie Notice. You can manage your cookie preferences at any time through the Cookie Preferences link in the footer.
10. No advertising commitment
We make the following commitments about advertising and data:
- No advertising on the Service. We do not display third-party advertisements on Ewance.
- No advertising targeting. We do not use your personal data, behaviour, or content to target advertising at you on Ewance or anywhere else.
- No sale or transfer to ad networks. We do not sell, share, or transfer your personal data to advertising networks, ad-tech intermediaries, or data brokers.
These commitments apply to all Ewance users. For details on how we use the third-party services that support the Service (hosting, authentication, analytics, AI tooling), see our Privacy Policy; our current Subprocessor list is available on request — contact [email protected].
11. Termination
11.1 Termination by you
You may close your account at any time through the account settings page.
11.2 Termination by us
We may suspend or terminate your access to the Service if you materially breach these Terms, our Acceptable Use Policy, or applicable law, or if we are required to do so by law or by a court order. Where reasonably possible, we will provide notice and an opportunity to address the issue before terminating.
11.3 Effect of termination
When your account is closed:
- Your access to the Service ends;
- Your profile becomes inaccessible to other users (including Recruiters);
- Your personal data is deleted or anonymised in accordance with the retention schedule in our Privacy Policy;
- Verifiable credentials previously issued to you on the LearnCoin infrastructure remain valid and verifiable (see Section 7);
- Sections of these Terms that by their nature should survive termination will continue to apply (including Sections 5.5, 6, 7, 14, 15, 16, 17, and 18).
12. Additional terms for Students
This section applies if you have a Student account. The terms in Sections 1 through 11 apply to you in addition to this section.
12.1 Purpose of the Service for Students
Ewance allows you to discover and complete real-world challenges, build a portfolio of completed work, earn verifiable credentials, and (optionally) make yourself discoverable to Recruiters who may be hiring for relevant roles.
12.2 No guarantee of employment
We do not promise or guarantee that using the Service, completing challenges, or earning credentials will result in any job offer, internship, contact from any Recruiter, or other employment outcome. The Service is a tool for skill-building and demonstration; outcomes depend on many factors outside our control.
12.3 No employment relationship
Aurea CV is not your employer, agent, or representative. We are not an employment agency or staffing firm. We do not supervise, direct, or control your work on challenges. We do not set your work hours, location, or methods. We do not provide training, equipment, or facilities for completing challenges. Any compensation, prize, or honorarium associated with a sponsored challenge is paid by the sponsor (or processed by us on the sponsor's behalf), not by Aurea CV as your employer.
12.4 Visibility to Recruiters
You control your visibility to Recruiters through your account settings. The default setting on a new Student account is not discoverable — Recruiters cannot see your profile until you affirmatively opt in. Once you opt in, you can choose among the following visibility levels:
- Anonymised — Recruiters can see your completed challenges and skills, but not your name or contact details.
- Identified — Recruiters can see your full profile, including your name and the contact channels you have chosen to expose.
- Contact-allowed — In addition to "Identified," Recruiters may send you messages through the Service.
You can change your visibility level at any time. Changing your level does not affect Recruiters who have already viewed or saved your profile under a previous setting.
12.5 Communications with Recruiters
Any communications you have with Recruiters through the Service are between you and the Recruiter. We are not a party to those communications and do not vet, endorse, or guarantee any Recruiter or any opportunity they describe. Apply the same caution you would when contacted by any prospective employer.
12.6 Pricing
The Service is available to Students under several tiers, which may include free and paid options. Current pricing and feature differences are described on the Ewance website. We reserve the right to change pricing with reasonable advance notice; changes will not affect any paid subscription term you have already committed to.
13. Additional terms for Recruiters
This section applies if you have a Recruiter account. The terms in Sections 1 through 11 apply to you in addition to this section.
13.1 Purpose of the Service for Recruiters
Ewance allows you to search for Students who have completed challenges relevant to your hiring needs, view their portfolios and credentials (subject to each Student's visibility settings), and contact Students who have opted in to receiving messages.
13.2 Permitted use
You may use the Service only for legitimate recruitment, talent identification, and hiring purposes related to genuine current or anticipated job openings at your organisation. You may not use the Service for:
- Marketing or selling products or services to Students;
- Collecting Student data for purposes other than recruitment;
- Discriminatory practices prohibited by applicable employment law;
- Building or supplementing a database, dataset, or AI training corpus;
- Resale, sublicensing, or transfer of Student data to any third party.
13.3 Compliance with employment law
You are solely responsible for ensuring that your use of the Service — including your search criteria, candidate selection, contact practices, and any subsequent hiring decisions — complies with all applicable employment, equal-opportunity, and anti-discrimination laws in your jurisdiction.
13.4 Use of Student information
When you view or download Student profile information, you become a data controller (independently of Aurea CV) with respect to that information. You must:
- Use the information only for the recruitment purpose for which it was made available;
- Comply with all applicable data protection laws (including GDPR if you are processing personal data of EU or EEA residents);
- Provide affected Students with any privacy notices required by applicable law;
- Honour Student requests to access, correct, or delete their personal data that you hold.
13.5 Acceptable contact
If a Student is "Contact-allowed" and you send them a message, your message must:
- Identify you and your organisation clearly;
- Relate to a genuine job opportunity, internship, or recruitment process;
- Not be unsolicited marketing material;
- Not be sent repeatedly if the Student has not responded or has declined.
We reserve the right to suspend any Recruiter account that violates these contact rules.
13.6 Pricing and paid features
Recruiter features are offered under one or more paid plans, described on the Ewance website. Where you sign up for a paid plan through the Service, payment is processed by our payment processor. You agree to pay all applicable fees in accordance with the plan you have selected. Failure to pay may result in suspension or termination of your Recruiter access.
13.7 Enterprise agreements
For Recruiters with larger team sizes, integration needs, or specific procurement requirements, we offer a separate Master Subscription Agreement with bespoke terms. Contact us at [email protected] to discuss.
14. Disclaimers
To the maximum extent permitted by applicable law:
The Service is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted availability.
We do not warrant that the Service will be error-free, uninterrupted, free of viruses or other harmful components, or that defects will be corrected.
We do not warrant the truthfulness, accuracy, or completeness of any user-submitted content, including challenge submissions, profile information, or Recruiter postings.
We do not warrant any specific outcome from your use of the Service, including but not limited to job offers, hiring decisions, or recruitment success.
Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law, including statutory rights of consumers, liability for death or personal injury caused by negligence, or liability for fraud or fraudulent misrepresentation.
15. Limitation of liability
To the maximum extent permitted by applicable law:
We are not liable for any indirect, incidental, consequential, special, punitive, or exemplary damages arising out of or in connection with your use of the Service, even if we have been advised of the possibility of such damages. This includes (without limitation) lost profits, lost revenue, lost data, loss of goodwill, and loss of opportunity.
Our total aggregate liability arising out of or in connection with these Terms or your use of the Service, across all claims, is limited to the greater of:
(a) EUR 100, or (b) the total fees you have paid us for the Service in the twelve (12) months preceding the event giving rise to the claim.
Carve-outs preserved. The limitations in this Section 15 do not apply to:
- Liability for death or personal injury caused by our negligence;
- Liability for fraud or fraudulent misrepresentation;
- Liability for gross negligence or wilful misconduct;
- Any statutory consumer rights that cannot be excluded or limited under applicable law;
- Liability arising from a breach of data protection law that results in regulatory penalty against you.
16. Indemnification
You agree to indemnify and hold Aurea CV (and its directors, employees, contractors, and agents) harmless from and against any third-party claims, losses, damages, and reasonable legal costs arising out of:
- Your breach of these Terms;
- Your violation of any law or the rights of any third party (including intellectual property and privacy rights);
- Your Content, to the extent it gives rise to a claim against us.
This indemnification obligation does not apply where the claim arises from our own breach of these Terms, our negligence, or our wilful misconduct.
For consumer Students, this indemnification is limited to claims arising from your gross negligence, wilful misconduct, or fraudulent acts. Ordinary breach of these Terms by a consumer Student does not trigger an indemnification obligation.
17. Changes to these Terms
We may update these Terms from time to time. When we do:
- For material changes (changes that significantly affect your rights or obligations), we will notify you by email to the address associated with your account at least 30 days before the change takes effect. Material changes take effect only after that notice period, and your continued use of the Service after the effective date constitutes acceptance.
- For non-material changes (typos, clarifications, formatting, contact details), we may make the change without advance notice. The "Last Updated" date at the top of these Terms will always reflect the most recent change.
If you do not agree with a material change, you may close your account before the change takes effect. You will not lose access to any verifiable credentials you have already earned (see Section 7).
18. General provisions
18.1 Governing law
These Terms are governed by the laws of the Republic of Estonia, without reference to its conflict-of-laws principles. Nothing in this section deprives a consumer Student of the protection of mandatory consumer protection rules of the EU member state in which they reside.
18.2 Jurisdiction
Any dispute arising out of or in connection with these Terms will be subject to the exclusive jurisdiction of the courts of Tallinn, Estonia. Consumer Students retain the right to bring proceedings in the courts of their EU member state of residence and to be sued only in those courts, in accordance with the Brussels Ibis Regulation (EU 1215/2012).
18.3 Out-of-court dispute resolution
Before initiating court proceedings, we encourage you to contact us at [email protected] so we can try to resolve the issue informally. EU consumer Students also have the right to use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
18.4 Assignment
You may not assign or transfer these Terms or your account to anyone else without our prior written consent. We may assign these Terms in connection with a merger, acquisition, restructuring, or sale of assets, provided that any successor takes on the same obligations to you and that we notify you of the change.
18.5 No waiver
If we do not enforce a provision of these Terms on any particular occasion, that does not mean we have waived our right to enforce it later.
18.6 Severability
If any provision of these Terms is found to be invalid or unenforceable, the rest of the Terms will continue in full force, and the invalid provision will be replaced with a valid provision that comes as close as possible to the intent of the original.
18.7 Entire agreement
These Terms (together with the Privacy Policy, Cookie Notice, Acceptable Use Policy, and any sponsored-challenge or enterprise agreement that applies to you) form the entire agreement between you and Aurea CV regarding the Service, and supersede any prior agreements or representations on the same subject.
18.8 Language
These Terms are drafted in English. We may provide translations for convenience, but in case of any discrepancy, the English version prevails.
18.9 Force majeure
Neither party is liable for any delay or failure to perform caused by events beyond reasonable control, including acts of nature, war, terrorism, pandemic, civil disturbance, internet or telecommunications failures, or government action.
